GENERAL PROVISIONS

NAC 453A.040 “Office” characterized. (NRS 453A.740) “Office” implies the State Department of Agriculture.

NAC 453A.050 “Assigned essential parental figure” characterized. (NRS 453A.740) “Assigned essential parental figure” has the significance credited to it in NRS 453A.080.

NAC 453A.052 “Division” characterized. (NRS 453A.710) “Division” implies the Health Division of the Department of Health and Human Services.

NAC 453A.070 “State Health Officer” characterized. (NRS 453A.710) “State Health Officer” means:

  1. The State Health Officer delegated in accordance with NRS 439.100; or
  1. The designee of the Administrator of the Division, if:

(a) No State Health Officer has been delegated in accordance with NRS 439.100;

(b) The position of State Health Officer delegated in accordance with NRS 439.100 is empty; or

(c) The State Health Officer delegated in accordance with NRS 439.100 is truant from the State.

NAC 453A.080 “Juvenile cannabis plant” and “developed marijuana plant” deciphered. (NRS 453A.740) For the reasons of part 453A of NRS:

  1. “Juvenile cannabis plant” means a cannabis plant with no detectable blossoms or buds.
  1. “Full grown cannabis plant” means a marijuana plant which has blossoms or buds that are promptly discernible by an unaided visual examination.

REGISTRY IDENTIFICATION CARD

NAC 453A.100 Application: Required going with data. (NRS 453A.210, 453A.740)

  1. Notwithstanding the materials needed by NRS 453A.210, an application for a registry distinguishing proof card must include:

(an) A composed articulation marked by the candidate’s going to doctor confirming that he was given a photographic recognizable proof of the candidate and the assigned essential parental figure, if any, and that the candidate and the assigned essential guardian, if any, are the persons named in the application;

(b) On structures recommended by the Department, any data needed by the Central Repository for Nevada Records of Criminal History;

(c) On structures recommended by the Department, any data needed by the Department of Motor Vehicles;

(d) A complete arrangement of the fingerprints of the candidate and the assigned essential parental figure, if any, taken by a state or nearby law authorization office;

(e) A legally approved medical marijuana program waiver and obligation discharge shape that is endorsed by the Department and marked by the candidate and assigned essential guardian, if any;

(f) A legally approved affirmation frame that is endorsed by the Department and marked by the candidate and assigned essential parental figure, if any;

(g) If the candidate is under 18 years old, a minor discharge structure marked by the assigned essential parental figure of the minor; and

(h) Proof that the candidate is an occupant, including, without constraint, a photocopy of a driver’s permit issued by the Department of Motor Vehicles or a photocopy of a recognizable proof card issued by the Department of Motor Vehicles.

NAC 453A.110 Written notification of endorsement or refusal of use; issuance of card by Department of Motor Vehicles. (NRS 453A.740)

  1. On the off chance that the State Department of Agriculture supports an application for a registry distinguishing proof card:

(a) The Department will give the candidate and assigned essential parental figure, if any, with composed notification of its support by enlisted mail.

(b) The candidate and assigned essential guardian, if any, must present the composed notice and evidence of character to a proper office of the Department of Motor Vehicles with a specific end goal to get a registry ID card. Upon the presentation of the composed notice and verification of personality, the Department of Motor Vehicles should get ready and issue a registry recognizable proof card to the candidate and assigned essential guardian, if any, after it has affirmed by phone or other solid implies that the State Department of Agriculture has sanction the issuance of the card.

  1. In the event that the Department denies an application for a registry distinguishing proof card, the Department will give the candidate and assigned essential parental figure, if any, with composed notification of its dissent by enrolled mail.

  1. A man who wishes to restore his registry recognizable proof card is not needed to consent to the procurements of section (d) of subsection 1 of NAC 453A.100.

NAC 453A.140 Fees. (NRS 453A.740) The Department will charge and gather the accompanying expenses:

Assigned PRIMARY CAREGIVER

NAC 453A.150 Restrictions. (NRS 453A.740)

  1. A man with an endless or incapacitating illness to whom a registry distinguishing proof card has been issued may not be an assigned essential parental figure.
  1. An assigned essential parental figure may not be the assigned essential guardian to more than one individual.

Request FOR QUALIFICATION OF DISEASE OR CONDITION AS CHRONIC OR DEBILITATING MEDICAL CONDITION

NAC 453A.200 Submission; secrecy; period for endorsement. (NRS 453A.710)

  1. A man may submit to the State Health Officer, in the structure recommended by the Division, an appeal asking for that a specific illness or condition be incorporated among the sicknesses and conditions that qualify as constant or crippling medical conditions.
  1. The substance of an appeal submitted as per subsection 1 are secret and, aside from as generally gave in NAC 453A.230, neither the State Health Officer nor the Division might uncover the name or other distinguishing data of:

(a) The individual who presented the appeal; or

(b) The going to doctor, if any, of the individual who presented the appeal.

  1. The Division, through the State Health Officer, will favor an appeal submitted according to subsection 1 inside of 180 days after the date on which the request is gotten.

NAC 453A.210 Review by State Health Officer; come back to candidate. (NRS 453A.710)

  1. The State Health Officer will audit every appeal that is submitted according to subsection 1 of NAC 453A.200 to figure out if:

(a) The appeal is in the structure endorsed by the Division;

(b) The appeal is finished; and

(c) The specific ailment or condition portrayed in the appeal is as of now included among the ailments and conditions that qualify as endless or incapacitating medicinal conditions.
